Know your rights as a carer

It is essential that you are aware of your rights so that you feel able to advocate for yourself if faced with challenging circumstances.

We also understand that many choose not to consider themselves as a carer; they are simply looking after their loved ones. Whether you do identify as a carer, or you prefer not to, it is still important that you understand your rights.

Below we identify key rights that you have, to ensure you are able to access the best support, benefits and entitlements to enable you to fulfil your caring role without a negative impact on your circumstances.

Explore your rights as a carer

From the 6 April 2024 The Carer's Leave Act became law in England, Scotland and Wales. This means carers balancing paid employment with caring responsibilities have access to five days' of unpaid carer's leave per year. 

If you are facing challenges with your employer, you can contact our Support Line who will be able to offer advice and support to enable you to reach a sustainable resolution.

Juggling paid employment with your caring responsibilities can be challenging, especially when considering financial implications. Carer Money Matters intends to empower carers with the knowledge to manage their finances well and access any financial assistance such as grants and benefits. Contact our Energy Advisor for specific advice tailored to your personal circumstances. 

The Flexible Working Act 2024 means you have a right to request a flexible working pattern from your employer from day one of your employment. 

This may be in relation to working days, working hours, or your place of work. You are able to request a change to the above twice a year. Your employer will be obliged to consider your request and consult with you further if they feel they are unable to accommodate the changes your have requested. 

If you are over 18 and provide unpaid care in any form, you are entitled to a carer's assessment to ensure you are accessing the support and assistance you need. 

You can request a carer's assessment by calling 01225 394570 and selecting option 2, Monday to Thursday, 8.30am to 5pm, and Fridays, 8.30am to 4.30pm. Alternatively you can contact our Support Line who can support you with this. 

Ensuring your GP records that you are a carer on your patient record has a number of benefits. It enables you to have access to priority services, vaccination clinics, and there is also a record of your additional responsibilities in case of an emergency to ensure your loved ones are looked after.

As a carer, it is vitally important you look after your own health and wellbeing to ensure you remain fit and well enough to care for your loved ones. 

If you are the main carer for an older or disabled person who may be put at risk if you became ill, or if you are in receipt of Carer’s Allowance, you should be offered a free flu jab. 

Contact your GP surgery to make an appointment, if you would like one.

If you are a carer and the person you care for is being discharged from hospital, the hospital must identify and consult with you, where possible.

If you need assistance with this, or if you feel this hasn't happened, the Support Team are able to signpost you and make a referral through to the Community Wellbeing Hub if required, who can offer specialist support in any number of areas relevant to you, including liaising with the Discharge Team at Bath RUH. 

Under law, you are protected from direct discrimination or harassment because of your caring responsibilities. 

Carers Rights UK have lots of really helpful information explaining different types of discrimination, and steps to follow if you feel you have been unfairly discriminated against.
